Mediation Fees


I provide estimates or fixed fee quotations wherever possible, based on an hourly rate of £250 plus VAT.

 

For example, for a mediation between two parties which is likely to require half a day (around 4 hours) of preparatory work and a full day (around 8 hours) of mediation, I would typically provide an estimate of £3,000 plus VAT.

Factors which are likely to influence the level of fees in a mediation include:

  • the volume of papers to be considered
  • the amount of liaison work required in advance of mediation
  • the number, complexity and potential financial impact of the issues
  • the number of parties and representatives.

 

Where the amount of work substantially exceeds the stated assumptions on which an estimate is based, I will check with the part(ies) responsible for paying the fees before carrying out the additional work.

The mediation agreement will include a clause dealing with responsibility for paying the mediation fees. This will need to be agreed in advance of the mediation.

The mediation fee may be invoiced in advance, in which case the fee must be paid before the mediation date as a precondition of the mediation going ahead.

Any additional fees or expenses not paid in advance will be invoiced after the mediation and must be paid within 7 days of invoice.


Expenses


Any necessary travel and/or accommodation expenses will be charged at cost, on a basis agreed in advance with the part(ies) responsible for paying the fees.


The mediation fees do not include any venue hire or catering costs. Where an external venue for a mediation is booked by us, this will be agreed in advance with the part(ies) responsible for paying the fees and charged at cost.


Cancellation/postponement


If, more than 7 days before it is due to take place, a mediation is cancelled or postponed by one or more of the parties, any irrecoverable expenses will be payable and any preparation time already spent will be payable at the applicable hourly rate.


If, 7 days or less before it is due to take place, a mediation is cancelled or postponed by one or more of the parties any irrecoverable expenses will be payable, together with a cancellation/postponement fee of 50% of the applicable mediation fee.

Unless otherwise previously agreed in writing by the parties, responsibility for payment of any cancellation/postponement fees or expenses will be split equally between the part(ies) responsible for paying the fees.


Consultancy and/or investigation fees


For many consultancy and/or investigation projects, I can quote a fixed fee once the scope of the project has been defined. Otherwise, an agreed hourly rate will apply. Please contact me to discuss. Invoices are usually issued on a monthly basis and fees are payable within 14 days of invoice.

Ombuds fees

Ombuds fees are subject to negotiation and agreement with the organisation concerned. Typically, there is a retainer fee plus an hourly rate, subject to a budgetary cap.
